The risks faced by parties to oil and gas contracts have increased together with the complexities of doing business in general, as there are now more regulatory, compliance, operational and social requirements to fulfil. Various factors that impacted the industry and continue to be critical for the parties engaging into drilling operations depend on dominating market conditions, however, the stability and consistency of risk allocation between the market players is the key for competitiveness of the entire industry. It is critical to maintain consistency with what is widely acknowledged to be “the norm” for contractual risk allocation in upstream oil and gas. Every company can achieve this by implementing Risk Allocation Procedure to describe the principles of contract risk allocation for all contracts it enters as a result of its procurement or commercial activities.

Olga Labai is both a practicing lawyer and trainer, with 18 years of professional experience providing legal advice on both a contentious and non-contentious basis within the upstream oil and gas sector. Prior to the establishment of OGC, she worked for Sakhalin Energy, the operator of the “Sakhalin-2” project in Russia, operator of the first LNG plant in Russia, and for Weatherford in the Middle East, where she covered all legal issues for Weatherford’s Iraq and Kurdistan operations.
